5. DEFINITIONS AND INTERPRETATION
5.1 To make these Terms and Conditions easy to read We have defined some of the words. If a word begins with a capital letter then this means that the word has been defined. A list of the defined words is set out below:

“Terms and Conditions” means these terms and conditions of sale which You can access on Our Website;
“Product(s)” means the product(s) which are available for purchase, and described, on Our Website;
“You” / “Your” means you as Our customer.
“Working Day” means any week day excluding public holidays;
6.1 Our products are made by hand and from where possible natural products. Due to this we consider slight variations in grain, shade, colour and tone are natural and individual characteristic of our furniture and are not viewed as a manufacturing fault.
6.2 We spend great efforts on ensuring the product photographs, viewable on www.benhomes.co.uk, are the truest representation of the products we sell. The photographs are taken in our studio and are high definition photos. When placing products in your home slight variations in the colour tone and shade my appear visible. Due to the nature of the natural materials used to manufacture our products we do not consider these in anyway faults but would classify them as inherent features of the materials we work with.
6.3 Our products are designed for domestic use and meant for the home. By purchasing our products you the customer adhere to our guidance, therefore if and when the product is placed and used in a commercial environment BH Furniture Ltd accept no responsibility for the deterioration our products may be subjected to from continuous rigorous use in a commercial environment.
6.4 Our products are hand made from natural materials and despite all products being subject to quality control and quality assurance checks at all stages on production and dispatch variations in colour and size may occur.
6.5 Due to the nature of wooden products and our products mainly being manufactured in the far east they are shipped a long way. Due to this they can be subject to extreme change in temperature. The wood used to manufacture our products has all been kiln dried to industry standard levels of moisture content, but due to the extreme temperatures and the nature of hardwood drawers and doors may be slightly stiff on arrival. This natural occurrence normally and should correct its self within a short time once the natural wood has adjusted to its new environment. Should this not happen our customer services team should be contacted to resolve this issue.
6.6 Should for any reason you are not happy with our products and feel they do not fit the description or may be faulty in anyway, it is of our upmost importance that we have happy customers. Please do contact us as soon as possible via our website addressing this issue affectively to receive a quick and easy resolution.
6.7 We cannot take responsibility for any marks, damage or loss of earnings incurred from the use of any of our products. You are responsible for making sure the product is suitable for your environment, particularly floors, which may be more prone to marking. You should consider adding additional cover or protection where appropriate.
6.8 We reserve the right to change the price, description and image of a product and withdraw a product from our range without prior notice. We reserve the right to cancel any order without notice. This does not affect your consumer rights.
7. PLACING AN ORDER
7.1 You must be 18 years of age or older to purchase products from our website.
7.2 Placing an order with us can be done via our website or calling 0800 689 1253.
7.3 It is your responsibility to provide us with correct and clear information at time of placing an order. Failure to do so my result in delayed delivery. Once we have received your order we will send you an email confirming the order and the personal details that have been provided. It is your responsibility to ensure all details provided are accurate and true.
7.4 An order is not accepted by us until we receive payment in full.
7.5 All orders are subject to acceptance by us. We will send you a confirmation e-mail after receiving your order and this will constitute acceptance by us. The contract between you and us will only be made when we send you this email. We will charge your chosen payment method after we accept your order. We will send a further email when your order has been dispatched.
7.6 Before ordering from us, it is your responsibility to check and determine your full ability to receive the Products ordered. This includes ensuring that the Products ordered will pass freely into your room of choice, they fit in that room, can be transported through the door of your flat or room, stairs and doorways, and there are no other issues that could make delivery more complicated or impossible.
7.7 You must keep the contact details we hold for you up-to-date so that we can contact you if necessary about your order or the delivery of the Products.
8.1 We reserve the right to change the price of products for any reason at anytime. This will have no effect on an order that has been received and is yet to be received by you.
8.2 In the event of any pricing errors that occur we are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you an order acceptance, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
8.3 The price of a Product includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect
8.4 Due to the large number of Products on our site, it is always possible that some of the Products listed on our site may be incorrectly priced, despite our reasonable efforts. We will normally verify prices as part of our order-handling procedure so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If the Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of the rejection.
9.1 Payment can be made by following the payment method on our website or over the phone. You can pay for your product at the time of order using charge debit or credit card.
9.2 When making a payment, the price of any product is the price at the date and time of your order. Payment is taken in full at time of order.
9.3 Discount codes that can be used to receive a discounted product are available from time to time. We do reserve the right to accept discount codes at anytime for any reason.
10.1 All deliveries are made to the door and not to a room of choice.
10.2 Deliveries are free and no extra cost will be added for delivery at the time of checkout.
10.3 On or very close to the delivery date you will receive correspondence from our delivery partner to notify you that your products are on their way.
10.4 On the day of delivery you will receive communication in the form of a text message and email from our delivery partner notifying you of your 1 hr time
10.5 At current we do not offer assembly or are able to unpack the items and take the packaging materials away.
11. REFUND AND RETURNS
11.1 In the event that your payment has been received in part or full for an order, which is subsequently cancelled, you will be reimbursed in full by the same method (and where applicable to the same debit/ credit card used)
11.2 If you wish to return or exchange your purchase you must notify us within 14 days of receipt via email. Please note that we do not offer a free returns service, you are required to pay for the transportation of any unwanted goods yourself. Returns are charged in relation to the size of the item. For an item up to 0.22cbm the return cost is £30. For an item up from 0.22-0.35cbm the return cost is £45. For an item from 0.35-0.75cmb the return cost is £55. For an item about 0.75cmb the return cost is £80. These cost will be deducted from the final refund.
11.3 We only accept returned items collected by our designated furniture delivery specialist and do not accept any returns made by couriers and delivery companies chosen by the customer.
11.4 Before returning your purchase, please ensure the goods are in the same condition as they were originally sent. Unwanted items must be returned in a fully resalable condition, which includes being in the original, unmarked and undamaged packaging. Please check your goods carefully before disposing of the packaging, we cannot arrange a collection for items that are un-boxed. If the item is not in its original packaging then collection will be refused.
11.5 BH Global Group Ltd retains the right to refuse a refund on any item deemed not to be resalable.
11.6 Once we have approved the condition of your return a refund will be made within 14 working days. We do not refund the original delivery charge paid.
11.7 In the event that you would like to cancel your order, we must receive your request in writing to firstname.lastname@example.org. The correspondence must come from the original email addresses assigned and used at time of purchase. Any other form of correspondence, a different email address or different route of correspondence cannot be considered as a valid request. Once we have received and confirmed your request for a refund, this will be made within 14 working days.
11.8 In the instance that either a PayPal or Credit Card dispute is raised before the 14 working day refund period, we consider this now an issue between yourselves (the customer) and PayPal, your Bank or your Credit Card provider. Disputes between yourselves and the above in all cases will take longer than 14 days to resolve.
